    Human Resources (Litigation)

 

  • Consultant on major pharmaceutical product liability and mass tort litigations, antitrust, and litigation involving labor and employment issues, such as the termination of employment relationships involving key executives.

 

  • Litigation consultation and management, such as for whistleblower cases involving anti-kickback issues, best prices, best values, Medicaid and Medicare, credentials misrepresentation, improper coding or upcoding goods or services, fraudulent billing, off-label marketing, patient information misrepresentation, procedures bundling or unbundling, self-referrals, and managed investigations of potential compliance and governance issues.

 

  • Managed and coordinated domestic and international litigation and document review legal teams, law firms, consultants and experts for various litigations, such as for pharmaceutical patent infringement.

 

  • Very successful collections and provided records management and records retention training and support to domestic and international personnel.

 

  • Management of the general litigation budget established by management, as well as reserves for each individual litigation, including allocations for outside counsel, subject matter experts (SMEs), consultants and support personnel.

  • Representation of claimants and payers regarding various government payers such as the Civilian Health and Medical Program of the Uniformed Services (CHAMPUS) (now TRICARE), Department of Veterans Affairs, Medicare, Medicare Advantage, Medicaid and the Federal Employee Health Benefits Program (FEHB)

 

  • Managed outside counsel in preparing for arbitrations, mediations and cases for litigation and hearings.

 

  • Consultation and management regarding strategy and resolution of employment practice liability (EPL) claims.

 

  • Provides risk management and other general advice to management and business partners regarding EPL matters.

 

  • Formulates strategy, facilitates execution and provides management of outside counsel on EPL litigation and related matters.

 

  • Coordinates with insurance carriers and outside counsel to manage all aspects of EPL budgets, discovery, litigation hold, litigation strategy, staffing, work flow, work product, and develops initiatives for reducing outside counsel spend.

 

  • Provides periodic reporting on EPL litigation results, budgets, forecasts, exposure analysis and litigation strategies.

 

  • Worked with relevant specialists and HR personnel on affirmative action, diversity and enforcement matters.

 

  • Coordination and management of internal and external legal teams, including consultants and subject matter experts (SMEs) engaged in various simultaneous activities, such as discovery, litigation, mitigation, remediation, risk management, strategies for litigated and investigative matters, third-party subpoena compliance.

 

  • Experience with claims, including pre-litigation dispute resolution, management of active litigation, responsibility for discovery and other litigation requests and procedures, review of pleadings and other court documents, the receipt of subpoenas and other information requests and inquiries from third parties.               

 

  • Supports employment litigation by management of outside counsel, including oversight of all litigation budgets.

 

  • Representation on matters such as civil rights, covenants not to compete, discrimination, due process, employment-related tort claims, enforcement, family and medical leave, FLSA, retaliatory termination, sexual harassment, terminations, trade secret issues, whistleblower actions, wrongful termination.

 

  • Representation of clients before the EEOC and certain government administrative bodies, at university hearings, in arbitration, at trial and on appeal.

 

  • All activities required to litigate and resolve client matters, such as conducting depositions, conducting evidentiary investigations, consulting with clients, drafting pleadings, drafting and responding to discovery, drafting and responding to motions, gathering evidence, interviewing witnesses, participating in oral arguments, researching and writing briefs, and settlement negotiations.

 

  • Confidentially negotiated and managed the successful resolution of employee grievances regarding claims of unfair termination, sexual harassment, workplace hazards (such as asbestos and PCBs), discrimination, PTO, compensation and other typical issues prior to Equal Employment Opportunity Commission (EEOC) hearings or litigation.

 

  • Initiated, managed and conducted litigation, and managed outside counsel for domestic alternate dispute resolution (ADR), arbitration, discrimination, EEOC cases, mediations, and sexual harassment claims.

 

  • Prepared correspondence and assisted in resolution of disputes related to employee grievances, arbitrations, litigation, and trial of employment related civil cases, and representation as required before federal, state and local agencies.

 

  • Maintains current knowledge of relevant government regulations, rules and statutes, such as the ADA, COBRA, ERISA, FLSA, FMLA, HIPAA and other applicable employment and labor laws, and fulfills compliance and reporting requirements.
